The Historical and Legal Foundations of the U.S. Military Prosecution of War Crimes Defendants, 1942-1948

The project will collect legal documents related to U.S. military prosecution of war criminals in the mid- to late- 1940s. The documents will be taken to the Research and Documentation Center for War Crimes Trials, where they will be analyzed by an international team of scholars. In its analysis, the team will focus on what the documentation reveals about the historical and legal foundations of the trials, especially the use of military courts as forums for the prosecution of war crimes. The research will lead to the composition of a monograph and a conference on war crimes trials.
